These terms apply to all custom and print-on-demand orders placed with Monomoy Goods LLC.
1. Customer Responsibility for Submitted Artwork
By submitting any text, images, logos, designs, graphics, or other content (“Artwork”) to Monomoy Goods LLC by upload, email, link, or any other method, you represent and warrant that:
- You own the Artwork or have obtained all necessary rights, licenses, and permissions to use it.
- The use of the Artwork for your order does not infringe on any copyright, trademark, intellectual property right, or other right of any third party.
You agree that Monomoy Goods LLC is not responsible or liable for verifying ownership of submitted Artwork and is not liable for any claims, damages, or legal actions resulting from the use of Artwork you provide.
You agree to indemnify and hold harmless Monomoy Goods LLC from any claims related to the Artwork you submit.
2. Proofing & Production Process
If your submitted design is not compatible with our laser etching or production process, our team may:
- Make minor adjustments to improve clarity or production quality, and/or
- Notify you of potential problem areas that may not etch or reproduce well.
A digital proof will be emailed to the email address provided with your order for review and approval before production begins.
3. Non-Response to Proof
If Monomoy Goods LLC sends a proof and you do not respond within 12 days of your order date, you authorize Monomoy Goods LLC to proceed with production exactly as shown in the proof sent, whether or not you specifically request a proof.
You acknowledge that failure to respond within this timeframe constitutes approval of the proof.
4. Marketing & Promotional Use
You grant Monomoy Goods LLC the right to photograph and use images of the final product, including products featuring your submitted Artwork, for:
- Advertising
- Marketing
- Social media
- Website display
- Portfolio and promotional purposes
No compensation is provided for this use.
5. Production Results Disclaimer
Due to the nature of laser engraving, leather, fabric, and other materials, slight variations in color, depth, alignment, and finish may occur. These natural variations are not considered defects.
6. Agreement to These Terms
By placing an order and submitting Artwork, you acknowledge that you have read, understood, and agreed to this Sales & Artwork Agreement.
